Starting November 1, Unpaid Social Insurance Can Be Fined Up to 3 Times! Must Read for Every Business Owner
Starting November 1, Unpaid Social Insurance Can Be Fined Up to 3 Times! Must Read for Every Business Owner
Let me start with a change that might keep you, as business owners, up at night.
From November 1, 2026, the whole country measures the failure to pay social insurance contributions with a single ruler.
Previously, tax enforcement standards varied from place to place. The same conduct might cost you 1 times the amount in one province and 3 times in another. That is no longer possible.
On September 28, 2026 the State Taxation Administration issued Announcement No. 20 of 2026, the National Tax Administrative Penalty Discretion Benchmark (2026 Edition), implemented nationwide in a unified manner from November 1. Failure to pay social insurance contributions has been formally written into Item 30 of the discretion benchmark, classified under "violations of tax (fee) collection administration", and divided into three penalty tiers.
First, let me correct a claim that many people take for granted.
Quite a few online interpretations say "the new rules add a 3 times fine". That is wrong.
Penalties of 1 to 3 times have always existed in Article 86 of the Social Insurance Law of the People's Republic of China:
Where an employer fails to pay social insurance premiums on time and in full, the social insurance premium collection agency shall order it to pay within a time limit or make up the shortfall, and shall, from the date of default, impose a late payment surcharge of 0.05% per day; if it still fails to pay after the deadline, the relevant administrative department shall impose a fine of not less than one times and not more than three times the amount in default.
What really changed this time is the discretion, not the power.
The new rules put the originally scattered and inconsistent discretionary space of different localities into a single nationwide table, clarifying "how much counts as light, how much counts as heavy", and drawing three tier lines with two dimensions, amount plus proportion.
In one sentence: the power to fine you has not changed, but the latitude on how much to fine has been sharply narrowed.
I. What This Table Actually Governs
The Discretion Benchmark (2026 Edition) divides common violations in the tax field into 9 major categories and 66 items, and for each item it specifies the fine amount across five tiers: "minor, relatively light, general, relatively heavy, serious".
This matters because it makes the discretion benchmark public.
The discretion benchmark existed before too, but it was scattered across regions with varying standards, and most taxpayers had no idea how their own locality divided things. Now a single nationwide table is posted online, and business owners can look it up and do the math themselves.
As a side note on background: this was not done in one step. It followed a path of "unified within the province, then unified within the region, then unified nationwide". For example, Guangdong previously used the Central South Regional Tax Administrative Penalty Discretion Benchmark (jointly issued by seven regions, Guangdong, Henan, Hubei, Hunan, Guangxi, Hainan and Shenzhen, effective April 1, 2024). After November 1, one ruler applies nationwide, and where regional standards conflict with it, the national version governs.
II. Unpaid Social Insurance: Who Is Covered, How the Fine Works
First, Scope of Application
This set of rules targets only employers and enterprises.
Flexible employment personnel who pay their own social insurance are not subject to this penalty rule set, and the enterprise discretion benchmark does not apply to them.
The Complete Penalty Process
The order must not be wrong, and this is where many people get confused:
Failure to pay or underpay social insurance
↓
Tax authority orders payment or make-up within a time limit
↓
Still unpaid after the deadline ← The fine starts at this step
↓
Fine of 1 to 3 times the amount in default
↓
From the date of default, a late payment surcharge of 0.05% per day is imposed (calculated throughout, not suspended by the penalty)
Three key points:
First, a fine is not the first response. The tax authority first orders payment or make-up within a time limit, and the fine only starts if payment is not made after the deadline. There is a window for rectification.
Second, the late payment surcharge accrues from the day of default, at 0.05% per day. That works out to an annualized 18.25%, and it cannot be escaped. A year of default costs you 18.25% of the principal.
Third, the fine cannot replace the make-up payment. The principal must be paid, the surcharge must be paid, and the fine must be paid. The three sums are cumulative, not either-or.
The Three Penalty Tiers
This is the part of the whole article you most need to remember.
| Tier | Amount in Default | Proportion of Social Insurance Payable | Fine Multiple |
|---|---|---|---|
| Tier 1 | Under 500,000 yuan | No limit | 1 times |
| Tier 1 | 500,000 to 5,000,000 yuan | Less than 30% | 1 times |
| Tier 2 | 500,000 to 5,000,000 yuan | More than 30% | 1 to 2 times |
| Tier 2 | More than 5,000,000 yuan | Less than 30% | 1 to 2 times |
| Tier 3 | More than 5,000,000 yuan | More than 30% | 2 to 3 times |
Here is a more usable way to put it:
- Under 500,000 yuan, or 500,000 to 5,000,000 yuan with a proportion below 30%, a fine of 1 times
- 500,000 to 5,000,000 yuan with a proportion above 30%, or more than 5,000,000 yuan with a proportion below 30%, a fine of 1 to 2 times
- More than 5,000,000 yuan with a proportion above 30%, a fine of 2 to 3 times
The base for the fine is the unpaid social insurance principal, and the late payment surcharge is calculated separately.
Note that the trigger for Tier 3 requires both conditions to be met, "a large amount plus a high proportion". This point is critical, and it is discussed separately below.
III. Where the Real Force of This New Rule Lies
Let us look at a set of figures first. This is a typical case published by the Shanghai Minhang District People's Court:
Ms. Li joined a company at a monthly salary of 16,000 yuan, and the company always contributed social insurance for her based on the local minimum base. Later her work injury was assessed as a seventh-grade disability, and because the contribution base was low, her lump-sum disability subsidy was short by tens of thousands of yuan. The court ruled that, because the company failed to pay in full based on actual wages and thereby reduced her work injury benefits, the company had to make up the full difference.
In this case, a low contribution base is more dangerous than paying nothing at all.
Why? Because paying nothing only brings a fine, while a low base directly shifts the work injury benefit gap onto the company's own pocket. The fine is capped at 3 times, but the work injury benefit gap has no upper limit.
Risk Exposure: Low Bases and Affiliation Arrangements
Under the new rules, the risk level of the following rises by one notch:
Long-term low-base declarations. Proportion is the second dimension of the tiers. Companies with a small amount in default but a high proportion fall into Tier 2, 1 to 2 times. Previously a small amount might have meant only make-up payment plus surcharge, but now there is an explicit multiplier.
Affiliating social insurance to another entity. The employee does not actually work for this entity, yet social insurance is affiliated to it. This involves both an inaccurate headcount and an inaccurate base, and the two stack.
Failing to report employees for social insurance. There are people on the payroll but no registration for coverage. Article 58 of the Social Insurance Law requires employers to complete registration within 30 days from the date of employment.
"Voluntary waiver of social insurance agreements". Many owners think this is a shield. It is void. Paying social insurance is a mandatory statutory obligation under the Labor Law and the Social Insurance Law, and does not belong to the category of benefits that the two sides can negotiate away. Such agreements are void because they violate mandatory provisions of law.
One More Easily Overlooked Item: Credit Penalties
Enterprise employee basic pension insurance, employee basic medical insurance (including maternity insurance), work injury insurance and unemployment insurance premiums have been brought into the scope of tax payment credit evaluation.
Failure to pay as required may affect the company's credit record and its participation in government procurement and bidding activities.
A fine of hundreds of thousands of yuan is an explicit account, while a drop in credit rating is a hidden account. The latter, where it blocks you from bank loans and bidding qualifications, is harder to fix than a fine.
IV. Two Real Bonuses, Do Not Miss Them
The new rules are not only about tightening. There are areas where they loosen, and they loosen substantially.
Bonus One: Voluntary Make-up Payment Can Aim for the Lowest Standard
This is the most valuable provision.
The discretion benchmark states clearly: those who actively cooperate with tax inspections, or who voluntarily pay the full amount of tax before the tax authority makes a decision, may have the lowest standard of each tier applied.
In other words, if you fall into the 1 to 3 times tier, and you can voluntarily pay up before the decision comes down, you can aim for 1 times.
This is not small money. For an arrears of 100,000 yuan, the difference between 1 times and 3 times is 100,000 versus 300,000.
This window is short. Once the decision is made, it no longer applies. Do not wait until the document arrives before you remember.
Bonus Two: The List of 8 "Minor, No Penalty" Items
The announcement attaches the List of Tax Administrative Penalty "Minor, No Penalty" Items, with 8 entries in total. Their common feature is that they do not require the premise of "first time". As long as the conduct is minor, is promptly rectified, and caused no harmful consequences, no penalty should be imposed:
- Failing to complete tax registration or deregistration on schedule
- Failing to complete changes to tax registration on schedule
- Failing to complete tax registration
- Withholding agent failing to complete withholding tax registration as required
- Failing to install or use tax control devices as required
- Failing to store and keep invoices as required (involving fewer than 25 copies)
- Lost invoices (limited to those explicitly invalidated, with the invoicing system already deactivated, or types already brought under information-based management, and where the report is made proactively with remedial measures taken)
- Internet platform enterprises failing to report tax-related information as required
The basis is paragraph 1 of Article 33 of the Administrative Penalty Law: where a violation is minor and is promptly rectified without causing harmful consequences, no administrative penalty shall be imposed.
This is a statutory "shall not penalize", not a favor granted by the tax department.
Beyond these 8 items, there are many other places in the discretion benchmark table where tiers marked "minor" likewise point to no penalty, only with the added condition of "first time within one year". Combined, the whole table contains 22 instances of "minor" circumstances that can go unpenalized.
V. Old-to-New Transition: What About Arrears Before November 1
This point is critical, and it protects you.
The old and the lenient both apply.
Original text of the announcement:
Where tax violations occurred before this announcement took effect and the tax authority has not yet made an administrative penalty decision for the tax violation, the provisions in force at the time the tax violation occurred shall apply, except where applying this announcement is more favorable to the taxpayer in paying fees.
Translated into plain language:
- For arrears that already occurred before November 1, if no penalty decision document has been made yet, the rules in force at that time apply in principle
- But if the new rules are more lenient and favorable to you, you may choose the new rules
There is one more opening: for minor violations that are voluntarily and promptly rectified with no harmful consequences, no penalty may be imposed under the law.
You have the initiative here. If you proactively pay up and rectify before the tax authority discovers it, or within the period of the order to pay within a time limit, that is "minor plus prompt rectification". Although the 8 items on the effective no-penalty list are mainly about registration and invoices, the principle of "voluntary rectification" applies generally.
So if you currently have historical arrears, the month before November 1 is a window.
VI. Three Things Finance Should Do in the Coming Month
First: verify the number of insured employees.
Go through the payroll, labor contracts and social insurance declaration forms line by line. Both over-reporting and under-reporting are problems, and an inaccurate headcount itself has an independent entry in the discretion benchmark.
Second: verify the contribution bases.
This step carries the highest weight under the new rules.
Compare three sets of data: actual employee wages, declared social insurance bases, and the local average wage upper and lower limits. Focus on identifying employees who are declared at the minimum base while their actual wages are far above it.
Why emphasize this separately? Because proportion is one of the tier dimensions. A low declared base worsens both the "amount in default" and the "proportion in default" at once, pushing both toward the higher tiers. More than 5,000,000 yuan with a proportion above 30% is Tier 3 at 2 to 3 times, which means multiplying an amount you already owe by 2 to 3 times on top of that.
Third: clear historical arrears.
Handle it before November 1, do not drag it past the effective date of the new rules.
The order matters: check bases and headcount first (to plug the future), then clear historical arrears (to close the past). If you do it the other way around, you clear the past and then keep declaring at the old base, and next year the whole thing happens again.
One More: Keep Evidence of Your "Attitude"
The discretion benchmark requires the applicable circumstances to be stated in the penalty decision. Cooperating with inspections, proactively providing materials, and truthfully explaining the situation will all be recorded. Conversely, non-cooperation or hiding materials will be directly classified as "serious circumstances".
These otherwise insignificant actions carry weight when the fine multiple is being decided.
VII. A Few Honest Judgments
The direction of this change is right.
How much a company will be fined now has a nationwide unified answer. For people running businesses, "predictability" is worth much more than "leniency". Only when you know where the boundary is do you know what must never be touched.
But do not read "predictability" as "leniency".
For false invoicing, violent resistance to tax collection, and repeat offences, the standards are still at the maximum. For false invoicing exceeding 2.5 million yuan, the illegal gains are confiscated and a fine of 300,000 to 500,000 yuan is imposed; for anyone who, having been punished twice or more for false invoicing within five years, again issues false invoices, the heavier penalty applies.
What this round unified is the discretionary space in the middle and lower tiers. The top tier has never been loosened.
One more reminder: no penalty does not mean no consequences.
Even where no penalty is imposed, the tax authority must still educate the party concerned; and late or omitted filings themselves affect the tax payment credit evaluation. When your credit score drops, invoice issuance, export tax rebates and bank loans are all affected. Saving a 200 yuan fine at the cost of losing your credit rating is a bad deal.
My last words to owners and finance teams: what really needs to change this time is not how much you pay, but never letting the contribution base slide past unclear again.
You have known the cost of social insurance compliance for a long time. You may not yet know the cost of dragging your feet. In the past you were betting on whether the local tax bureau would come after you. That bet no longer exists.
Let us talk in the comments: has your company always been compliant on social insurance bases? Have you ever stepped on a landmine?
